Terms of Service

These Terms of Service ("Terms") govern your use of MerchStamp's storefront, social media accounts, and any content or services we provide. By placing an order, following our accounts, or otherwise interacting with MerchStamp, you agree to these Terms.

Our Products

MerchStamp sells print-on-demand apparel and goods. Products are produced by our fulfillment partner (Printify) at the time of order. Colors, sizing, and print placement may vary slightly from product photos due to the nature of print-on-demand manufacturing.

Orders and Payment

All orders are subject to acceptance and availability. Prices are listed at the time of purchase and are subject to change without notice for future orders. Payment is processed securely through our storefront's payment provider; we do not store your full payment details.

Shipping and Fulfillment

Production and shipping times vary by product and are estimated, not guaranteed. We are not responsible for delays caused by our fulfillment or shipping partners once an order has been submitted for production.

Returns and Issues

If your order arrives damaged, defective, or incorrect, contact us within 30 days of delivery so we can make it right. Because items are produced to order, we do not accept returns for reasons of preference (e.g., wrong size chosen, changed mind) unless required by law.

Social Media and Content

MerchStamp posts and engages with the public through TikTok, Instagram, Facebook, and YouTube. Use of those platforms is also governed by each platform's own terms. Content we post, including designs, photos, and video, is owned by MerchStamp unless otherwise noted and may not be reused commercially without our permission.

YouTube API Services

MerchStamp uses a private internal tool that accesses YouTube API Services to publish our own original videos to our own YouTube channel. By interacting with any part of MerchStamp that uses YouTube API Services, you agree to be bound by the YouTube Terms of Service. Google's handling of data received through those services is governed by the Google Privacy Policy, and access may be revoked at any time through the Google security settings page.

Acceptable Use

You agree not to misuse our storefront or social accounts, including attempting to disrupt their operation, submitting fraudulent orders, or infringing on our intellectual property.

Disclaimer of Warranties

MerchStamp provides its products, storefront, and content "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our storefront or social accounts will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, MerchStamp is not liable for indirect, incidental, special, or consequential damages arising from your use of our storefront, products, or social accounts. Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid for the product giving rise to the claim.

Indemnification

You agree to indemnify and hold MerchStamp harmless from any claim, loss, or damage, including reasonable legal fees, arising from your misuse of our storefront or social accounts, your violation of these Terms, or your violation of any right of another party.

Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of MerchStamp will be brought exclusively in the state or federal courts located in Ohio, and you consent to that jurisdiction.

Changes to These Terms

We may update these Terms from time to time. The "Effective" date above reflects the most recent revision. Continued use of MerchStamp after a change means you accept the updated Terms.
